House rules:
- This is a hobby for me so this is non-profit.
- Each share gives the right to 5% of the cask.
- All costs (cask purchase, duty, bottling, labelling, VAT, etc.) will be distributed among the shareholders in proportion to their ownership percentage.
- Once the initial payment is received, you will receive a certificate via email.
- All participants will be added to a WhatsApp group used to keep everyone updated. Opting out for this is of course possible.
- Participation in this investment represents a commitment for the full 10-year duration. Early withdrawal or return of funds is not an option. However, shareholders are free to sell their shares.
- If the amount of bottles coming out of the cask cannot be divided by 20, the remaining bottles will be divided in samples.
Example: If we receive 195 bottles, each share is worth 9 bottles and 525ml of samples. Of course 2 shares will be worth 19 bottles and 350ml of samples.
*Kilchoman Terms:
The purchase includes the cost of the spirit as well as the cost of warehousing and insurance for a period of ten years. Further charges will be made thereafter on an annual basis which will be charged at the current rate at the time. Warehousing of the cask must remain in one of the Kilchoman warehouses on Islay for the entire duration of maturation, up to bottling. It is the responsibility of the owner to make sure Kilchoman are kept up to date with any changes of address and contact details.
Kilchoman must be informed of any change in ownership. The ownership of the cask may only be transferred to another named individual who is of legal age for consuming and purchasing alcoholic beverages. Kilchoman has first refusal rights on any cask sold. Upon transfer of ownership, the new owner shall be deemed to be bound by these terms and conditions. A reasonable administration fee shall be payable on each change of ownership.
If, despite our reasonable efforts, we are unable to contact you within 12 months of the expiry of the initial 10 year storage period included in the purchase price, and/or you fail to make any payment when due, we may at our sole discretion end the contract and hold what we reasonably consider to be the then current monetary value of the bulk spirit on your behalf. If, five years after having held such monies on your behalf, we are still unable to contact you then we shall be entitled to retain the monies or donate all or a proportion of the monies to charity.
During maturation spirit naturally evaporates from the cask at an average annual rate of 2%. You acknowledge that this percentage may vary slightly from year to year. Each cask will have a different capacity and we cannot guarantee the exact amount of spirit filled. The oak cask itself will remain the property of Kilchoman.
The cask purchase prices are under bond, excluding duty and VAT. A further payment of Duty, bottling and labelling plus value added tax (VAT) at the then prevailing industry rates will be due when the owner deems the cask ready for bottling and must be paid prior to delivery of the bottled whisky to you. Bottling and labelling will be done by Kilchoman Distillery in our packaging with various options for label text and emblems / crests and to be approved by Kilchoman. Purchasers are not permitted to change the packaging or labelling of the whisky after delivery of the goods without written consent from Kilchoman.
